The use of MyChart is completely voluntary and is not required to receive health care from The Queen's Medical Center. "Queen's" means The Queen's Medical Center, 1301 Punchbowl St, Honolulu, Hawaii 96813, and it's controlled affiliates that own and/or operate one or more hospitals or physician practices located in Hawaii. Queen's is sometimes referred to as "we," "us," or "our" in these terms and conditions.

For all medical emergencies, go to the Emergency Department of a local hospital or dial 911.

MyChart should not be used to communicate urgent matters to your health care provider - please call your physician's office if you have an urgent question or concern.

Your MyChart Record

When we provide health care services, we are required by law to maintain records that document your care, including (but not limited to) medical history, current health status and relevant diagnoses regarding acute or chronic conditions or problems, all test results and reports, and any treatments, therapies or procedures provided or performed. We may maintain your information in paper format or electronically - or a combination of both. For purposes of these Terms and Conditions, "electronic medical record" means the electronic portion of your medical record.

Information about the care and services you receive, such as medical history, current conditions, treatment plan and all treatments given, including the results of all tests, procedures and therapies, is maintained in the electronic health record.

MyChart provides you with access to some (but not all) of the information contained in your electronic medical record. Sometimes, MyChart shows a summary or a description of your information, and not the actual entries made by a physician that are otherwise included in your physician or hospital-based medical record. As a result, you should not rely on information accessed via MyChart as complete.

If you need a complete medical record, please make your request through the established procedures for requesting medical records of the physician practice or hospital where you are receiving your medical care.

MyChart is a secure online portal that allows a patient, or a person who the patient chooses (proxy), to have secure web-based access to selected medical information from the electronic health record. MyChart does not reproduce a patient's entire health record online. MyChart is a selected part of the information in the electronic health record, such as prescriptions, basic test results, summary medical history, appointments and similar information. Your provider may decide which types of information to release into MyChart.

Individuals who are enrolled in MyChart agree to use MyChart as one way to obtain tests results performed at participating facilities. Test results will be delivered to MyChart in most cases. Individuals who are enrolled in MyChart also agree that an electronic copy of their discharge instructions be provided for each inpatient admission.

When the MyChart patient and his or her spouse share an account they will both have access to billing account summary information (this information is not confidential to the patient). To ensure confidentiality, please call your health system's business office to request a separate account.

We reserve the right to terminate access to MyChart at any time, for any reason. A user's access to MyChart will be terminated if the user has misused or abused the system, violated any terms of use, or used the system for purposes other than those for which it is intended to be used.

Restrictions for MyChart Records of Minors

MyChart may be available for adult (18 and older) patients of Queen's who have an electronic medical record at a Queen's physician practice or hospital system where MyChart has been implemented. MyChart may also be available to legal representatives, guardians and/or other authorized persons who may act as health care proxies of Queen's patients. If you are not within this group of authorized persons, you are not permitted to use MyChart.

Parents and legal guardians may request access to their minor child's health information through MyChart. This is a type of proxy access (access by one person to another person's MyChart record). The amount of information the parent will be able to see in MyChart depends on the age and legal status of the minor. The limits on MyChart access does not affect any other right the parent may have to obtain a minor child's records. More information about proxy access is available in frequently asked questions.

Your Privacy and Security Responsibilities

When you sign up to use MyChart, you will be given an activation code. You will use that code to create a MyChart ID and password. This ID and password will allow you to view your medical information, submit comments that may become part of your medical record, and in some cases, communicate with your health care provider. It is important that you keep your access code, MyChart ID and password completely confidential and secure. You should change your password immediately if you believe that your security may have been compromised. In addition, you should change your password regularly to help keep your account secure. You can change your password online at any time by signing into MyChart and choosing the "Change password" option. The privacy of your medical information is carefully protected by your health care providers.

Modifications

We may modify these Terms and Conditions at any time. Any modifications made to these Terms and Conditions will be effective immediately upon your agreement. Any aspect of MyChart may be changed, supplemented, deleted or updated with or without notice at the sole discretion of Queen's.

MyChart Messaging Terms of Use

MyChart Messaging is to be used for non-urgent medical matters only.

For all urgent medical matters, dial 911, go to an emergency room, or contact your physician's office by phone.

I understand that MyChart messaging is granted for the purpose of managing my personal medical care or the medical care of someone whose MyChart account I have been granted proxy access to. Any use of MyChart unrelated to these purposes may result in termination of MyChart messaging privileges.

Improper use of MyChart messaging includes, but is not limited to:
* Use of language that is threatening, harassing, abusive, obscene, or discriminatory.
* Sending messages unrelated to your medical care.
* Sending messages on behalf of another person, unless the message is sent from an approved MyChart proxy account.
* Sending messages to a provider or clinic that has severed the physician/patient relationship.

I understand that I will receive MyChart email notifications when new information is available. These notifications will be sent to the email address I provided when I signed up for MyChart. These messages will not contain any confidential medical information. You will need to sign in to you MyChart account to access the full message. Any person with access to the email account to which these messages are sent will be able to see the notifications.

MyChart Share Electronic Health Records

If you gave consent to share your electronic health record with affiliated partners you will have one MyChart account with a unique ID and password. You will access all of your health information across all organizations in this single MyChart account.

If you declined consent to share your electronic health record with affiliated partners, you will have multiple MyChart accounts, one for each organization that will each have a unique ID and password. You will need to sign in to the specific MyChart account for each organization to get your health information.

MyChart Privacy and Security

Notices of Privacy Practices applicable to you are available from your physician practice and from the hospital where you receive treatment. These notices explain how health information about you may be used and disclosed, and your rights with respect to your health information.

Queen's MyChart is accessed through a secure, password-protected web site. The security of any data you submit via MyChart is very important to us. This site uses encryption technology, and we regularly review our security practices to help ensure that your data is maintained securely.

Password rules are in place to help ensure password confidentiality.
Vulnerability assessments are performed regularly.
All access is logged and monitored.

However, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information sent to us. Moreover, when you transmit information via the public Internet, your information will be transmitted over a medium that is beyond our control, and therefore the security of the transmission may be compromised before it reaches us. Accordingly, Queen's can make no guarantee as to confidentiality or security. In addition, by using MyChart you hereby expressly and solely assume the risk of any unauthorized disclosure or intentional intrusion, or of any delay, failure, interruption of corruption of data or other information transmitted in connection with the use of MyChart.

Your user name and password should be kept confidential. Failure to do so may also compromise the confidentiality of your information.

Additional Requirements and Restrictions

When using MyChart, you agree that you shall:

Comply with these Terms and Conditions; comply with the law; keep your User ID and account password strictly confidential; and promptly notify us of any unauthorized use of your MyChart account or password - or if you learn of any other security breach related to MyChart.

In addition to other restrictions set forth in these Terms and Conditions, when using MyChart, you agree that you shall not:

Impersonate any other person; use any portion of MyChart as a destination linked from any unsolicited bulk messages or unsolicited commercial messages ("spam"); use any automated process or service (such as a BOT, a spider, periodic caching of information, or "meta-searching") to access and/or use MyChart; use any unauthorized means to modify or reroute, or attempt to modify or reroute, MyChart; or damage, disable, overburden, or impair MyChart (or the network(s) connected to MyChart) or interfere with anyone's use of MyChart).

Deactivation of Your MyChart Account

Queen's reserves the right to deactivate your MyChart account at any time, for any reason without notice. Without limiting the forgoing, account deactivation typically will result from: failure to abide by these Terms and Conditions; or inappropriate use of messaging (e.g., messaging that is excessive, unnecessary or contains inappropriate content).

Accounts also are automatically deactivated after a number of consecutive failed login attempts.

Copyright and Trademarks

All content associated with MyChart and this Web Site, such as text, photographs, graphics, data formatting and presentation, button icons, images, artwork, names, logos, trademarks, and service marks (collectively, the "Content"), in any form including the compilation thereof, is the sole property of Queen's or third party licensors, subject to any rights you may have under applicable state law. Except as set forth in these Terms and Conditions, the direct or indirect reproduction of the Content, in whole or in part, by any means, is prohibited without the express written consent of Queen's Health System, Inc.

Web Site Access and Licenses

Queen's grants you a limited license to use MyChart, this Web Site and the services associated therewith in accordance with these Terms and Conditions. This license expressly excludes, without limitation, any reproduction, duplication, sale, resale or other commercial use of MyChart, this Web Site or the associated services, or making any derivatives of the same. All rights not expressly granted herein are reserved by Queen's and our third party licensors.

No Warranties

This web site, MyChart and the content contained therein are provided by Queen's on an "as is" basis. Queen's makes no representations or warranties of any kind, express or implied as to the operation of its web site, MyChart or the content, products and/or services included therein. To the fullest extent permissible by applicable law, Queen's disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for particular purposes, workmanlike effort, title and/or infringement. Queen's does not warrant that your use of MyChart or this web site will be uninterrupted or error-free, that defects will be corrected, or that the web site or the content accessible from this web site are free of viruses or other harmful code or defect.

Limitation of Liability

Queen's is not liable for any indirect, incidental, special or consequential damages, losses or expenses arising in connection with your use or inability to use MyChart or this web site or in connection with any failure of performance, error, omission, inaccuracy of information, interruption, delay or defect in operation or transmission, computer virus or line or system failure, even if Queen's has been advised of the possibility of such damages. In no event shall Queen's total liability for direct damages, regardless of the form of action or claim, whether in contract, tort (including negligence), and delict or otherwise exceed one hundred dollars ($100.00).

Indemnification

You agree to indemnify Queen's and any of our or their successors, assigns or licensees, together with our and their respective officers, directors, employees and agents, against any damages, losses, liabilities, judgements, costs or expenses (including reasonable attorney's fees and costs and all other fees and costs of defense) arising out of (a) a claim by a third party relating to your use of MyChart, or (b) your breach or violation of these Terms and Conditions.

General Legal Terms

These Terms and Conditions set forth the entire understanding and agreement between us and you with respect to your use of MyChart and this Web Site. You agree that such agreement may be assigned by us, in our sole and absolute discretion, to a third party in the event of a merger, acquisition or liquidation. Our failure to act with respect to a breach of such agreement by you or others does not waive our right to act with respect to a subsequent or similar breach.

You agree that the laws of the State of Hawaii, without regard to principles of conflict of laws, will govern these Terms and Conditions, and any dispute that might arise with respect thereto between you and Queen's or our or their officers, directors, employees or agents. You expressly and irrevocably agree that exclusive venue and jurisdiction for any such dispute shall be in the state courts of the City of Honolulu, Hawaii, or in the United States District Court for the City and County of Honolulu, and you further expressly and irrevocably consent to the exercise of personal jurisdiction in such courts in connection with any such dispute.

To the extent any portion of these Terms and Conditions is determined to be unenforceable by a court of competent jurisdiction, such portion will be modified solely to the extent necessary to cause such portion to be enforceable, and these Terms and Conditions, as modified, will remain in full force and effect.
